Terms of Service

Welcome to Asiatek AI. These Terms of Service ("Terms") govern your access to and use of the Asiatek AI platform and API services (the "Service") provided by Asiatek AI. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Asiatek AI provides an AI model API aggregation and distribution platform that enables developers to access multiple AI models through a unified, OpenAI-compatible API interface. Our Service includes:

• Access to AI models from multiple providers (including Qwen by Alibaba Cloud/ByteDance and DeepSeek models)
• Unified API endpoint compatible with the OpenAI SDK
• Usage-based billing with subscription plans
• Infrastructure hosted in Singapore with low-latency access for Southeast Asia

Asiatek AI is a legitimate AI infrastructure platform that aggregates and redistributes access to AI model APIs, similar to how cloud service providers aggregate and distribute computing resources. We maintain proper licensing agreements and comply with the terms of all upstream model providers.

2. Account Registration

To use the Service, you must register an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials and API keys
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Being at least 13 years of age (or the minimum age in your jurisdiction)

3. Subscription Plans and Payments

We offer the following subscription plans:

• Starter (Free): Limited API access with rate limits for prototyping
• Pro ($29/month): Enhanced API access with higher rate limits and priority support
• Enterprise ($99/month): Full API access with highest rate limits and dedicated support

Payments are processed through Creem, our authorized payment processor. Subscription fees are billed monthly in advance. API credits are non-refundable once consumed. All prices are listed in USD.

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Generate illegal, harmful, threatening, abusive, or defamatory content
• Violate any applicable local, national, or international laws or regulations
• Infringe upon the intellectual property rights of others
• Attempt to reverse engineer, decompile, or disassemble the Service
• Resell or redistribute API access without written authorization
• Use automated means to abuse the API (e.g., spam, denial of service attacks)
• Circumvent rate limits, access restrictions, or security measures
• Create child sexual abuse material (CSAM) or content exploiting minors
• Generate content that promotes violence, terrorism, or self-harm
• Interfere with or disrupt the Service or servers connected to the Service

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

5. API Usage and Rate Limits

Each subscription plan includes specific rate limits and usage quotas. Exceeding these limits may result in temporary request throttling. We may adjust rate limits with 7 days' notice. You are responsible for monitoring your API usage and costs.

6. Intellectual Property

• Your Content: You retain ownership of all input data, prompts, and content you submit to the Service.
• AI Output: Output generated by AI models through the Service is owned by you, subject to the applicable model provider's terms of service.
• Our Platform: Asiatek AI retains ownership of the Service, including its infrastructure, API design, branding, and underlying technology.

7. Service Availability and Support

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Service interruptions may occur due to:

• Scheduled maintenance (with at least 24 hours advance notice via email or status page)
• Upstream AI model provider outages (beyond our control)
• Force majeure events
• Emergency security patches

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Asiatek AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid in the preceding 12 months
• We are not liable for the content generated by AI models
• We are not liable for losses due to upstream provider outages

9. Indemnification

You agree to indemnify and hold harmless Asiatek AI from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your account if you violate these Terms, with or without prior notice depending on severity. You may cancel your subscription at any time through your account settings or by contacting support@asiatekai.com. Upon termination:

• Your API access will be revoked
• Unused API credits expire and are non-refundable
• We will delete your account data within 30 days, except as required by law

11. Refund Policy

Monthly subscription fees are non-refundable. Unused API credits expire at the end of each billing cycle. If you believe you have been incorrectly charged, please contact support@asiatekai.com within 30 days of the charge for review.

12. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through arbitration in Singapore in accordance with the Singapore International Arbitration Centre (SIAC) rules.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on our website at least 14 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
